There are particular real estate terms
that a Las Vegas homeowner should be aware of when someone's
property is either being used by another party or is related
to another property.
EASEMENT RIGHTS is a right-of-way that is granted to an individual
or a company that has authorized access to or over the Las Vegas
property-owner's land. For example, an electric company that
needs access to a particular property may obtain a right-of-way
across a private property for the purpose of doing business.
An ENCROACHMENT is an obstruction of some sort. It could also
be a building, or part of a building, that intrudes beyond its
legal boundary onto neighboring private or public land or a
building that extends beyond the building line.
An ENCUMBRANCE is a legal right or interest in Las Vegas land
which affects a good or clear title and, thereby, diminishes
the land's value. Zoning ordinances, claims, liens, mortgages,
pending legal action, restrictive covenants, easement rights,
unpaid taxes and charges are some examples of an encumbrance.
The way to reveal the existence of an encumbrance is to perform
a title search. It is the responsibility of the Las Vegas
home buyer to determine whether he wants to move forward
on a purchase with the encumbrance or he must decide what can
be done to remove it.
